Ordinance to amend the Zoning and Site Plan Review Ordinance Section 6, regarding Nonconforming Residential Structures on conforming or non-conforming lots.

A public comment period will not be included with this item because a public hearing was held regarding this matter at an earlier date.


ACTION: Council action is anticipated.
Summary:
The Council held a hearing on April 8 and the Planning Board held its MRA Hearing on April 2.  Please find attached the comments of the Planning Board.  Code Enforcement Officer Justin Brown recommends amending Section 6 to allow detached accessory structures to be treated identical to attached accessory structures.  The current ordinance allows attached structures when a lot or structure is nonconforming but does not allow a detached structure.  It is also suggested that tear down/rebuilds of structures should be treated the same as expansions and enlargements. Please find attached a brief overview of the amendment, the original draft amendment language and an optional version (one with mark up and one clean) dated April 15 prepared based on the discussion at the April 8 meeting.
