Order to authorize the Town Manager to accept a pedestrian easement near the intersection of Leighton Road and Gray Road; such easement is associated with the future development of an abutting parcel.
ACTION: Town Council action is anticipated.
At their January 8, 2013 meeting, the Planning Board granted Site Plan Approval for a medical office building on Lot 7 in the West Falmouth Crossing development at the corner of Gray Road and Leighton Road. As part of the project, the developer (7 West Falmouth Crossing, LLC) will be constructing sidewalks along the propertyâ€™s Gray Road and Leighton Road frontages in accordance with recommendations in the Townâ€™s Bicycle and Pedestrian Master Plan. A portion of the proposed Leighton Road sidewalk (approximately 200 linear feet) is located outside of the Leighton Road right of way and on private property owned by the developer. The developer has offered to provide a pedestrian
easement over that portion of the proposed sidewalk that will lie on private property to ensure that the public has rights to travel over this area. The Council is being asked to accept the public easement being offered by the developer.
The site plan conditionally approved by the Planning Board is attached. The location of the proposed public easement is shown in hatching on the plan and is labeled â€śProposed Pedestrian Easement From 7 West Falmouth Crossing LLC to Town of Falmouth (1,670 square feet)â€ť.
