Subject:
Order to adopt amendments to net residential area requirements, Section 5.31 of the Zoning and Site Plan Review Ordinance.

ACTION: Council action is anticipated.
Summary:
Due to an oversight in the previously adopted amendment in January of this year, staff are recommending an amendment to clarify the treatment of nonconforming lots due to lot area, and lots approved by the Planning Board with reduced lot area, in the Resource Conservation Overlay District.

An intro letter, staff cover memo and the amendment language are attached.

At their meeting on April 5, 2011, the Planning Board, acting in their capacity as the Town's Municipal Reviewing Authority, held a public hearing on these amendments.  There was no public comment, and the Board voted 5-0 to recommend passage of the amendment as written.  A memo from Senior Planner Ethan Croce is attached.
