Order regarding a Zoning Amendment to correct an unintended conflict between the West Falmouth Master Plan Development District and the Route 100 Corridor Overlay District regarding signage.

ACTION: Council action anticipated.
Summary:
Staff have discovered that there are conflicts between the dimensional requirements for the West Falmouth Master Plan Development District and the Route 100 Corridor Overlay District.  It is recommended, based on historical application of the ordinance, to exempt properties in the WFMPDD from the more strict sign provisions in the Overlay District. Excerpts from the WFMPDD portion of the Zoning Ordinance and the Exit 10 Design Guidelines are attached, along with an introduction letter from Councilor Libby. This item was introduced at the meeting on April 27, 2009, and a public hearing was held at the May 26 meeting. At their June 2 meeting, the Planning Board held a public hearing as the Town’s designated Municipal Reviewing Authority on the proposed amendment to Section 3.14.3 of the Zoning and Site Plan Review Ordinance pertaining to signage regulations in the West Falmouth Crossing Master Planned Development District. There was no public comment at the hearing and the Planning Board voted 4-0 to recommend that the proposed amendment be approved as written.
